Prostitution is illegal in Florida, as it is through the rest of the U.S. (except in certain areas of Nevada and in Rhode Island, where street prostitution and the operation of a brothel are illegal). Lewd conduct is most often associated with indecent exposure in Florida. However, lewd acts can be associated with prostitution, as engaging in lewd conduct for money basically defines prostitution. The term “lewd” is defined as an act that is sexual in an offensive way. This can be associated with indecent exposure in that others would be subject to the offender’s nudity for his or her gratification or arousal or to cause the shock or arousal of others.
Any sex crime charge is a serious matter. Prostitution and lewd conduct are no exception. Although first and second convictions for prostitution are considered misdemeanor offenses, these still carry severe penalties for the defendant. Jail time, fines and sex offender registration are the main penalties a defendant may face. For multiple offenders, the possibility of serving time in a state correctional facility exists. |
